On 26 September 2013, the Insolvency Service published a working draft of the proposed Insolvency Rules 2015, intended to replace the existing Insolvency Rules 1986. A further working draft was issued on 27 March 2015. This note provides an overview of the key changes contained in the proposals, referencing the March 2015 draft.
Note: We have not updated this note substantially for the further draft of the new rules that was published on 22 July 2015, as this draft will be subject to further revision in the short term. (We have therefore also preserved the references to the IR 2015, rather than the IR 2016 as renamed in the July 2015 draft, as a reminder of this.) Practitioners should therefore use this document as a starting point for their research only. The exception is that we have updated the section Aims of the proposed Insolvency Rules 2015 and timescale for implementation.
