On 6 April 2024, a number of changes to CPR 28.2 and CPR 31.5, regarding the approach to disclosure, were implemented through the Civil Procedure (Amendment) Rules 2024 (SI 2024/106). The revised version of CPR 28.2 as published on the justice.gov.uk website does not appear to accurately reflect the changes implemented by the SI. In any event, the apparently intended changes have made some perhaps surprising deletions and raise a number of queries.
