The US Department of Labor's (DOL) Veterans' Employment and Training Service (VETS) has issued a final rule revising the regulations implementing the reporting requirements under the Vietnam Era Veterans' Readjustment Assistance Act of 1974 (VEVRAA).
On September 25, 2014, the DOL's Veterans' Employment and Training Service (VETS) issued a final rule revising the regulations implementing the reporting requirements under the Vietnam Era Veterans' Readjustment Assistance Act of 1974 (VEVRAA). The modifications provide the agency with more meaningful data on federal contractors' employment and hiring of protected veterans.
VEVRAA requires covered federal contractors to report annually the number of veterans employed and hired during a reporting period who belong to specific categories protected under the statute. Before a 2002 amendment in the Jobs for Veterans Act (JVA), the regulations required federal contractors and subcontractors to submit annual reports listing the number of veterans employed and newly hired for contracts entered into before December 1, 2003 worth $25,000 or more, separated by job category and hiring location.
The 2002 amendment in the JVA modified the regulations by:
  • Increasing the contract value threshold for mandatory reporting from $25,000 to $100,000.
  • Requiring reports on "qualified covered veterans," defined as:
    • disabled veterans;
    • armed forces service medal veterans;
    • veterans who served on active duty during a war or in a campaign or expedition for which a campaign badge has been authorized; and
    • recently separated veterans.
  • Requiring reporting on the Federal Contractor Veterans' Employment Report VETS-100A form.
The final rule:
  • Rescinds the regulations requiring reports on government contracts and subcontracts predating December 1, 2003.
  • Requires contractors and subcontractors to report the total number of protected veterans employed to work on contracts of $100,000 or more entered into or modified since December 1, 2003, rather than the number of protected veterans in each occupational category, as was previously required.
  • Renames the annual report the "Federal Contractor Veterans' Employment Report VETS-4212."
  • Permits electronic filing of reports.
  • Replaces the term "other protected veteran" with "active duty wartime or campaign badge veteran."
  • Replaces the term "covered veteran" with "protected veteran," defined as a:
    • disabled veteran;
    • recently separated veteran;
    • active duty wartime or campaign badge veteran; and
    • armed forces service medal veteran.
The rule will take effect on October 27, 2014 and compliance will be required starting with the 2015 annual reporting period.
