High Court rejects application of interim order to prevent award of contract | Practical Law

The High Court has rejected an application by an unsuccessful bidder in a procurement process for an interim order to prevent the award of the contract to the successful bidder. The High Court found that the claimant had only demonstrated a weak case in relation to one of the alleged breaches. In relation to certain allegations of error of assessment by the contracting authority, even if true, these would not have made a difference to the outcome of the procurement process. The claimant had not, therefore, shown sufficient causation. Due to the claimant's weak case and the potential damage to the procurement process, the balance of convenience rested in not granting the interim order.
