The House of Lords has allowed an appeal by head tenants against a decision of the Court of Appeal that a head tenant is not entitled, under the Leasehold Reform, Housing and Urban Development Act 1993, to an extended lease of an individual flat comprising part of the headlease demise.
This significant decision may come as a surprise to many landlords, who could now face unexpected lease extension claims from their head tenants.
