The Court of Appeal in Redfearn v Serco t/a West Yorkshire Transport Service overturned the EAT decision that an employee was entitled rely on the Race Relations Act 1976 when he was dismissed for membership of the BNP. It therefore restored the tribunal decision on the ambit of the term "on racial grounds".
