Court holds that Rome II applies to motor compensation dispute | Practical Law
An update on Jacobs v Motor Insurers Bureau [2010] EWHC 231 (QB), in which the court considered whether Council Regulation (EC) No 864/2007 on the law applicable to non-contractual obligations (Rome II) applied to determine the applicable law in a dispute relating to compensation for a motor vehicle accident in Spain. Note: The Court of Appeal allowed an appeal against this decision and set aside the first instance judgment (Jacobs v MIB [2010] EWCA Civ 1208) see Legal update, Rome II does not apply to assesment of compensation payable to Motor Insurers Bureau.
