Court of Appeal allows interim injunction to prevent award of contracts | Practical Law

In a recently published judgment, the Court of Appeal upheld an order of a High Court judge who granted an interim injunction against the London Borough of Newham preventing it from entering into any contract or framework agreement relating to a tender for the procurement, management and maintenance of private sector leased accommodation. The Court considered that there was a seriously arguable case that the council had breached its obligations of transparency and fairness in the way in which it weighted assessment criteria. Further, it did not consider that damages would be an adequate potential remedy for the unsuccessful bidder.
