US Citizenship and Immigration Services (USCIS) has announced a process change for Form I-526, Immigrant Petition by Alien Investor, from a first-in, first-out basis to a visa availability approach. This change becomes effective March 31, 2020.
On January 29, 2020, US Citizenship and Immigration Services (USCIS) announced a process change for Form I-526, Immigrant Petition by Alien Investor, from a first-in, first-out basis to a visa availability approach.
Under this change, EB-5 visa applicants who are subject to immigrant visa backlogs (currently, those chargeable to China, India, and Vietnam) may experience delays in petition processing.
The new visa availability approach will apply to petitions pending as of March 31, 2020,the effective date of the change.
On March 13, 2020, at 11:00 a.m. to noon Eastern, USCIS will provide information and answer questions from the public about these operational changes.
