This note provides practical guidance on the interpretation (construction) of wills and private trusts. Referring to case law and legislation, it considers the principles of interpretation that apply when interpreting wills and trusts and the methods available to reach a solution, either with or without an application to court. It also considers when background evidence can be admitted to court to aid interpretation and highlights areas where problems commonly arise.
