Initial Disclosure

In cases in the Business and Property Courts, that are subject to PD 57AD ("Disclosure in the Business and Property Courts"), provision, by each party to the other parties, at the same time as its Statement of Case, of a List of Documents accompanied by copies (usually in electronic form) of the following:
  • The key documents on which it has relied (expressly or otherwise) in support of the claims or defences advanced in its statement of case (including documents referred to in that statement of case).
  • The key documents that are necessary to enable the other parties to understand the claim or defence they have to meet.
The relevant rules, including details of circumstances in which Initial Disclosure is not required, are set out in PD 57AD.5.1 to 5.14.
PD 57AD took effect on 1 October 2022, replacing PD 51U, and implementing, on a permanent basis, the procedures that applied, from 1 January 2019 until 1 October 2022, under the Disclosure Pilot Scheme (PD 51U). For more information, see Practice notes, Disclosure in the B&PCs: some FAQs and Disclosure in the B&PCs: key procedural steps up to the first case management conference.
