European Commission publishes Communication on industrial property rights strategy | Practical Law

The European Commission has adopted a Communication setting out a strategy for industrial property rights (IPR) for Europe. The Communication is concerned with rights in industrial property (such as patents, trade marks and protected geographical indications (GIs)), as opposed to copyright. In the Communication, the European Commission sets out various actions to enhance IPR protection in the Community, including an evaluation of the Community and national trade mark systems, a study on patent quality in Europe, an assessment of the feasibility of GI protection for non-agricultural products, and a consultation on the impact of standardisation on intellectual property (IP) rights in the information and communications technologies sector. The Communication is part of a package on IP rights, the other elements being a Green Paper on copyright in the knowledge economy (see Legal update, European Commission publishes Green Paper on copyright in the knowledge economy) and proposals to extend the term of copyright for sound recordings (see Legal update, European Commission publishes proposals on term of copyright for sound recordings and co-written musical compositions).
