June 2020 Final Regulations Under ACA Section 1557: Nondiscrimination in Health Programs and Activities | Practical Law

A Practice Note addressing final regulations issued by the Trump administration's Department of Health and Human Services (HHS) in June 2020 regarding nondiscrimination requirements under Section 1557 of the Affordable Care Act (ACA). Section 1557 prohibits discrimination on the basis of race, color, national origin, sex, age, or disability in certain health programs and activities. The final regulations, which repealed, redesignated, or replaced certain provisions of the HHS final regulations issued under the Obama administration in May 2016, reduced compliance obligations for Section 1557 covered entities. Re-proposed regulations issued by the Biden administration in August 2022 would undo many of the changes under the June 2022 final regulations.
