A Practice Note addressing key issues when litigating civil nuisance claims under Pennsylvania common law. Specifically, this Note explains preliminary considerations when bringing either a claim for private nuisance or a private (nongovernment) claim for public nuisance, the elements that a plaintiff must plead and prove when pursuing these claims, and the potential remedies.
