A Checklist of issues creating potential litigation risks for private employers in the US as they plan and implement a business reopening after being ordered to close or reducing operations in response to the COVID-19 pandemic or other public health emergencies. This Checklist addresses potential liability under anti-discrimination laws, paid leave laws, the National Labor Relations Act (NLRA), workers' compensation laws, workplace safety and health laws, whistleblower protections, and more in a rapidly changing legal, economic, and social climate. It is based on federal law but highlights those issues where state or local law may impose different or additional requirements.
