Rights and Benefits

As defined under the Uniformed Services Employment Reemployment Rights Act (USERRA), the terms, conditions, or privileges of employment, including any advantage, profit, privilege, gain, status, account, or interest earned under an employment contract or agreement or an employer policy, plan, or practice. Rights and benefits specifically include any:
  • Rights and benefits under:
    • a health plan; or
    • an employee stock ownership plan.
  • Insurance coverage and awards.
  • Bonuses.
  • Supplemental unemployment benefits.
  • Vacations.
  • The opportunity to select work hours or location of employment.
The rights and benefits of employees on covered military leave are governed by USERRA (for more information, see Practice Note, Military Leave Law: Military Leave Under USERRA and Employees' Reemployment Rights Under USERRA).
