Energy Charter Treaty (ECT)
A multilateral investment treaty that establishes a legal framework for energy trade, transit and investment between member states. Part III of the ECT contains substantive protections for investors, including the requirements of:
Most-favoured-nation treatment.
National treatment.
Fair and equitable treatment.
Protection from unreasonable or discriminatory measures.
Expropriation.
Compensation.
The ECT allows investors to file claims against ECT member states before international arbitration tribunals for violations of substantive ECT rights.
