This note provides an overview of annual leave entitlements under the National Employment Standards in the Fair Work Act 2009 (Cth), with some consideration of related obligations and entitlements under modern awards and enterprise agreements. It considers which employees are entitled to annual leave and when employees can take annual leave. It also provides guidance on payment for annual leave, directions for employees to take annual leave and cashing out of annual leave.
