Practical Law China has published the Chinese Civil Code series to discuss the impact of the Code in the areas of contract law, guarantee and security law, tort law, e-commerce operation, privacy and IP protection respectively.
On 28 May 2020, the National People's Congress of China (PRC) enacted the Civil Code of the PRC (the Code), with effect from 1 January 2021.
The Code is the first legislation of China enacted as a "legal code" (法典). It consolidates a number of existing civil laws enacted and revised in piecemeal fashion over the last 40 years. The following laws will be simultaneously repealed when the Code takes effect:
  • General Principles of the Civil Law 1986.
  • General Rules of the Civil Law 2017.
  • Contract Law 1999.
  • Property Law 2007.
  • Tort Liability Law 2009.
  • Security Law 1995.
  • Marriage Law 2001.
  • Inheritance Law 1985.
  • Adoption Law 1998.
The enaction of the Code, which provides legal rules affecting almost all aspects of private life in China, is therefore a momentous occasion for the Chinese legal system.
It is expected that many of China's existing regulations are to be reviewed against the norms of the Code, and more new ones may be enacted as an on-going legislative project as the country transitions to the new era.
