Although both the FTC and DOJ have withdrawn Statement 8 of the Joint Statements of Antitrust Enforcement Policy in Health Care, which set out safety zones for physician network joint ventures, it continues to provide a useful analytical framework in the absence of contradictory regulatory or caselaw developments.
