This Practice Note discusses pregnancy discrimination under Title VII of the Civil Rights Act of 1964 (Title VII), the Pregnancy Discrimination Act (PDA), the Pregnant Workers Fairness Act (PWFA), the Family Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA), and the Fair Labor Standards Act (FLSA), as amended by the Providing Urgent Maternal Protections for Nursing Mothers Act (PUMP Act). This Note discusses federal law prohibiting discrimination, harassment, and retaliation against job applicants and employees based on pregnancy, childbirth, and related medical conditions, as well as reasonable accommodation requirements.
