This note explains the availability and imposition of penalties under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law. It identifies the provisions which give rise to exposure to civil penal penalties and criminal penalties, the maximum penalties, the legal principles which apply when the court considers the appropriate level of penalty and the practice involved in penalty hearings and settlements involving agreed penalty proposals.
