The following list reflects some of the most important Health and Welfare Plan resources we published or substantially revised during Q2 2021:
COBRA Premium Assistance Under ARPA-21: IRS Guidance (Part I). This practice note addresses IRS implementing guidance reflecting premium assistance requirements for health plan continuation coverage under COBRA. The premium assistance was required by federal legislation enacted in March 2021 in response to the COVID-19 pandemic (American Rescue Plan Act of 2021 (ARPA-21)).
HIPAA Security Rule. We've updated this resource for federal legislation, enacted in January 2021, under which HHS must consider (in enforcing HIPAA) whether covered entities (CEs) or business associates (BAs) have implemented and applied certain recognized security practices, including with regard to cybersecurity.
Mental Health Parity Requirements Under the CAA-21. This resource is updated to reflect the Departments' FAQ guidance (April 2021) addressing a CAA-21 requirement, effective since February 2021, under which plans and insurers must provide the Departments their comparative analyses for nonquantitative treatment limitations (NQTLs).
SPD Language, Subrogation and Reimbursement. We updated this resource for recent subrogation and reimbursement litigation, including a Seventh Circuit decision addressing whether a plan beneficiary was required to repay a health plan under the plan's reimbursement provision.
