This Note provides an overview of the key issues relating to employment discrimination and workplace harassment in China. It covers characteristics protected from discrimination under Chinese legislation, including sex, disability, disease carriers and migrant worker status. The Note discusses issues relating to harassment in the workplace, liability for employers and/or employees who engage in discriminatory practices or harassment and areas of judicial uncertainty arising from inadequacies in the current law. It gives best practice suggestions for employers to minimise and deal with employment discrimination and harassment in the workplace.
