Social Distancing Policy | Practical Law

An employee policy on social distancing (also known as physical distancing). This policy provides protocols and procedures to help employers maintain a safe and healthy workplace when reopening after closures caused by a public health emergency, such as the COVID-19 pandemic. The policy is based on general guidelines issued by the Centers for Disease Control and Prevention (CDC) and the Occupational Safety and Health Administration (OSHA) and includes various other social distancing measures that employers may adopt depending on their industry, location, employee vaccination rates, community transmission rates, and workforce composition. This document is jurisdiction-neutral. Employers must adapt this policy to comply with applicable state and local reopening standards and requirements, though most government-imposed restrictions have now been lifted. This Standard Document has integrated notes with important explanations and drafting tips.

NOTE: As of August 11, 2022, the CDC's COVID-19 prevention guidance no longer include specific social distancing recommendations, but only generally suggest that individuals may want to avoid crowded areas or keep a distance between themselves and others (CDC: COVID-19: How to Protect Yourself and Others; CDC Press Release). This resource has not be substantively updated to reflect that guidance since most employers are no longer implementing or enforcing social distancing policies as a COVID-19 prevention measure.
