A form of guaranty that can be used in nonrecourse commercial loans governed by New York law. In this Standard Document, the guarantor guarantees the payment and performance of the borrower's loan obligations if and to the extent the borrower has recourse liability for those obligations under the loan documents. This Standard Document favors the lender but has integrated notes with important explanations and drafting and negotiating tips for borrowers and guarantors.
