This note discusses the principles, practice and procedure which apply to creditor applications to wind up a company in insolvency (including, in particular, where the company has failed to comply with a statutory demand). It addresses the court's jurisdiction to make a winding up order, creditors' standing to make the application, the procedure for making a winding up application and grounds for opposing the application.
