A Practice Note discussing how to draft an application in aid of litigant's rights under N.J. R. 1:10-3 to compel a non-party witness to comply with a subpoena ad testificandum or duces tecum in the New Jersey Superior Court, Law Division, Civil Part or in a non-foreclosure action in the Chancery Division, General Equity Part. This Note addresses the contents of an application to enforce a subpoena that a party serves during pretrial discovery (discovery subpoena) or for trial (trial subpoena), including the order to show cause (OSC), brief, supporting affidavit or certification, proposed order, and proof of service. It also addresses the contents of the opposition and reply papers.
