Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM Act)
The US federal statute governing unsolicited commercial email (spam) (
15 U.S.C. §§ 7701
to
7713
). Among other things, the CAN-SPAM Act:
Prohibits false or misleading email header information and deceptive subject lines.
Requires all commercial email messages to disclose certain information.
Requires senders to provide recipients with a way to opt-out of receiving future commercial emails.
Requires commercial emails containing "sexually oriented material" to include certain warning labels.
The CAN-SPAM Act sets out penalties for violations, including increased penalties for willful or aggravated violations.
