The US Patent and Trademark Office (USPTO) has issued a revised version of the Trademark Trial and Appeal Board Manual of Procedure (TBMP).
The USPTO has released the June 2016 version of the Trademark Trial and Appeal Board (TTAB) Manual of Procedure (TBMP). The TBMP provides information and guidance for litigating cases before the TTAB. Though focused primarily on opposition and cancellation proceedings, it also includes information on interference proceedings, concurrent use proceedings, and ex parte appeals of trademark examining attorney actions to the TTAB.
For the period March 1, 2015 through March 4, 2016, the June 2016 version incorporates relevant:
  • Amendments to the Lanham Act, the Trademark Rules of Practice, the Federal Rules of Civil Procedure, the Federal Rules of Evidence, and the Federal Circuit Rules of Practice.
  • Updates in TTAB, US Court of Appeals for the Federal Circuit, and other federal court case law.
New this year, the searchable electronic version of the TBMP now includes citations that link directly to electronic versions of the Code of Federal Regulations and the Lanham Act.
