In Rooproy v Rollins-Elliott and another the EAT held that a tribunal could not award compensation in a race discrimination claim against a company which had ceased to exist at the time the award was made. The tribunal had also erred in holding that it could not apportion the compensatory award and by taking a party's ability to pay into account when making such an award.
