This August, Practical Law China has expanded its inbound M&A coverage with the publication of Practice note, Taking security in private equity investments in China. This note covers the Chinese law and practice of taking a security interest in the context of a private equity investment in a company incorporated in China, from the perspective of an advisor to a private equity (PE) investor.
For competition practice area, we have published Article, Anti-trust investigations in China: a practical guide. This article provides an overview of the types of conduct subject to anti-trust scrutiny of Chinese regulators, including a summary of noteworthy cases.
For data privacy practice area, we have published Practice note, Data privacy in China. This note gives an overview of the regulatory environment for data privacy protection in China, and in particular the issues that businesses operating in China or dealing with Chinese counterparts need to be aware of and what they should do to ensure compliance and minimize risk when handling personal information in China.
In addition, we have strengthened our employment coverage with the publication of Checklist, Social average monthly salary: China. This checklist introduces the concept of China's social local average monthly salary and addresses the legal implications of this important benchmark figure.

New content

Inbound M&A

We have published Practice note, Taking security in private equity investments in China. The note adopts the perspective of an adviser to a PE investor. It covers the types of security interest that exist in the Chinese system, includes diagrams and explanations of the principal security structures used in practice and provides practical guidance on the documents involved, negotiation and drafting points and procedural issues.

Data privacy

We have published Practice note, Data privacy in China. The note presents an overview of the regulatory environment for data privacy protection in China, and in particular the issues that businesses operating in China or dealing with Chinese counterparts need to be aware of and what they should do to ensure compliance and minimize risk when handling personal information in China.

Employment

We have published Checklist, Social average monthly salary: China. The checklist addresses the concept of China's social average monthly salary, explains how this data is collected and calculated for statistical purposes. It also sets out the details of how this data is used to set the lower and upper limits of the base to calculate certain employee payments and benefits, with a table summarising the current data in Beijing, Shanghai, Guangzhou and Shenzhen respectively.

Competition

We have published Article, Anti-trust investigations in China: a practical guide. This article reviews anti-trust enforcement regime in China. It gives an overview on the types of conduct subject to anti-trust scrutiny in this region, including a summary of noteworthy cases. The article explains the procedures on conducting anti-trust investigations in China, with a flowchart to illustrate a typical investigation process.
