A Practice Note explaining the procedure for filing a motion to dismiss in a Texas district or county court under the Texas Citizens' Participation Act (TCPA), the anti-strategic lawsuit against public participation (anti-SLAPP) statute. Specifically, this Note provides a brief overview of the TCPA, discusses strategic reasons for raising the TCPA, and identifies procedural issues specific to an anti-SLAPP motion to dismiss, including when to file the motion, the parties' burdens of proof, and damages available to the moving and nonmoving parties.
