Derivatives Clearing Organization (DCO)
A derivatives
clearinghouse
(CCP) that is registered with the Commodity Futures Trading Commission (CFTC) and therefore eligible to clear
non-security-based swaps
under Title VII of the Dodd-Frank Act. Swaps for which a final Title VII clearing determination has been made must be cleared through a DCO. To date, these include certain
credit default swaps
(CDS) and
interest rate swaps
(see
Legal Update, Final Clearing Determination for CDS and Interest Rate Swaps Issued by CFTC
). DCOs also provide clearing services for other CFTC-regulated products, such as futures and options. For more information on DCOs and swap clearing under Title VII, see
Practice Note, US Derivatives Regulation: Swap Clearing and Trade Execution
. For details on the mechanics of derivatives clearing, see
Practice Note, Mechanics of Derivatives Clearing
