Transitory Impairment
Under the
Americans with Disabilities Act of 1990
(ADA), as amended by the
Americans with Disabilities Act Amendments Act of 2008
(ADAAA), an impairment with an actual or expected duration of six months or less.
Under the ADAAA and its implementing regulations:
A transitory impairment can
substantially limit
a
major life activity
.
An individual is not
regarded as having such an impairment
if the impairment is objectively both transitory and minor.
