A Standard Clause that can be included in a collective bargaining agreement (CBA) to waive the application of state or local laws where those laws permit waivers of certain employment terms, such as paid sick leave, minimum wages, meal or rest periods, or work scheduling limitations, through collective bargaining. It is based on the National Labor Relations Act (NLRA), but includes phrases commonly required for a valid collectively bargained waiver under state and local laws. It also may be used by private sector employers governed by the Railway Labor Act (RLA) or public sector employers. This Standard Clause has integrated drafting notes with important explanations and negotiating tips.
