A Practice Note explaining how to draft a subpoena for use in a civil action pending in the New Jersey Superior Court, Law Division, Civil Part (including in a Complex Business Litigation Program action) or in a non-foreclosure action in the Chancery Division, General Equity Part. This Note explains when parties must use a subpoena to compel an individual or entity's appearance at a deposition or trial. It also addresses the formatting, organization, and contents for subpoenas ad testificandum and subpoenas duces tecum that parties serve during pretrial discovery (discovery subpoenas) and in anticipation of trial (trial subpoenas). This Note also identifies the language to include in a discovery subpoena when counsel only want documents and not testimony.
