A Standard Document used by a corporation or an individual to appoint a third party (an attorney) to represent the principal (sometimes known as the grantor) and act on the principal's behalf under Chinese law. The Chinese term is 委托书.
This power of attorney is drafted to authorise the attorney to send a cease and desist letter in the context of enforcing the grantor's intellectual property rights (IPRs), but may be adapted to delegate different powers to the attorney for use in various legal matters.
This Standard Document assumes a Chinese language translation will be prepared to accompany the English language text and will execute the bilingual version as a single document. If no translation is prepared, clause 3 (language) in this Standard Document may be replaced with a standard clause following the steps set out in the drafting notes to the language clause in this Standard Document.
