A Checklist outlining the issues that plaintiff-side counsel should consider when representing plaintiffs who are currently employed by the defendant employer. This Checklist discusses what counsel should look for during the initial consultation, how represented employees can respond to performance reviews, confidentiality issues, and the gathering of evidence by a current employee. State ethics rules may impose additional or different requirements that are beyond the scope of this Checklist.
