This note considers the notice of termination obligations of an employer under the National Employment Standards (NES) in Part 2-2 of the Fair Work Act 2009 (Cth) (FW Act). It considers the requirement for an employer to give written notice of the day of termination of employment, and the amount of notice of termination that must be given or paid in lieu. It also considers when an employer is excluded from the obligation to provide statutory minimum notice of termination under the NES, and the interaction between the statutory minimum notice of termination requirements and the definition of notice of dismissal for the unfair dismissal regime contained in Part 3-2 of the FW Act.
