A Practice Note describing issues plaintiff-side counsel should consider when opposing a summary judgment motion in federal court under Rule 56 of the Federal Rules of Civil Procedure (FRCP) in a non-class action litigation. This Note describes FRCP Rule 56 and the summary judgment standard, the evidence collection process, and tactics for drafting the opposition to the motion.
