Subsisting rights

The subsisting rights of an occupational pension scheme member are the member's entitlements (pensions and any other benefits already in payment) and accrued rights under the rules of the pension scheme.
The member's accrued rights at a particular point in time consist of the value of the benefits accrued to him calculated as if immediately before that time the member's pensionable service terminated.
For these purposes a member includes the surviving spouse, civil partner, child or other dependant of a deceased member.
