Charging order

A way of securing a money judgment debt obtained in litigation by imposing a charge over the beneficial interest in land, securities or certain other assets of a judgment debtor (person against whom a judgment was given or made). To realise funds to satisfy the judgment debt, the judgment creditor must go on to also obtain an order for sale. For more information, see CPR 73, Charging Orders Act 1979, and Practice notes, Charging Orders, Charging orders in family law proceedings and Charging orders: protection and priority. See also Practice note, Orders for sale following charging orders over land.
