A Practice Note discussing a post-trial motion under Civil Practice Law and Rules (CPLR) 4404. This Note addresses a post-trial motion for judgment as a matter of law (also known, in a jury case, as judgment notwithstanding the verdict, or JNOV) or for a new trial in the interest of justice or on the ground that the verdict is against the weight of the evidence, including a motion for additur or remittitur. This Note also addresses appellate review of the order deciding the motion.
