The decisions of WorkPac Pty Ltd v Skene [2018] FCAFC 131 and WorkPac Pty Ltd v Rossato [2020] FCAFC 84 are explored in detail, as is the High Court of Australia decision of WorkPac Pty Ltd v Rossato [2021] HCA 23, which upheld an appeal against the approach adopted by the Full Court of the Federal Court of Australia in characterising the employment relationship.
