This note provides an overview of the application of Australia's foreign investment framework to investments in land and other land-related interests, including the grant of leases, agreements for lease and securities in landholding entities.
It describes when notification and approval under the foreign investment framework is required and the conditions that the Foreign Investment Review Board (FIRB) may attach to any approval. It also sets out the exemptions and exemption certificates available for land-related transactions.
The note also highlights the ongoing or additional reporting and record-keeping obligations imposed on foreign persons that have invested in land (including a foreign person's obligation to report certain actions involving Australian land on the Register of Foreign Ownership of Australian Assets) and includes an overview of the vacancy fee that is imposed on residential land.
