Employment contract (劳动合同)

Also translated as "labour contract".
Employment contracts are agreements reached between employers and employees to establish a labour relationship and define the rights and obligations of each. Employers for this purpose are entities established in China such as foreign invested enterprises, state-owned enterprises, and privately owned enterprises. A contract for full time employment must be in writing. The term “employee” is not defined but is understood to include both Chinese citizens and foreigners. Certain provisions elements must be included in an employment contract, and if any of those is omitted, it will be implied by law, failure of which might lead to interpretation in favour of the employees in employment disputes.
