A Practice Note summarizing the waivers issued by the Department of Health and Human Services (HHS) of certain Stark Law requirements due to the impact of COVID-19 crisis on health care. HHS issued 18 blanket waivers effective nationwide on March 1, 2020. These blanket waivers ended on May 11, 2023, when the Public Health Emergency ended. HHS also permits parties to request individual waivers of requirements that are not covered by the 18 blanket waivers. This Note contains information about the individual and blanket waivers. It is based on federal law and regulations.
