Commercial Court, London Circuit Commercial Court and Regional Circuit Commercial Court forms: HM Courts and Tribunals Service (HMCTS) published new court forms for the Commercial Court, London Circuit Commercial Court (LCCC) and Regional Circuit Commercial Court (RCCC), with immediate effect, for new and existing cases, from 24 January 2022 (see Legal update, New court forms for Commercial Court, London Circuit Commercial Court and Regional Circuit Commercial Court from 24 January 2022). The pdf versions of the new Commercial Court forms, the LCCC forms and the RCCC forms are available here (see Commercial Court forms, London Circuit Commercial Court forms and Regional Circuit Commercial Court forms). We have also added Word versions of the Commercial Court forms and the LCCC and RCCC forms.
GDPR: Shortly after the Data Protection Act 2018 came into force, in order to seek to comply with the General Data Protection Regulation and the Data Protection Act 2018, HMCTS made available a copy of a "Privacy notice for Civil Court forms". HMCTS will send out the notice with material dispatched by courts in relation to civil proceedings.
We understand that this is an interim solution and that eventually all civil court forms will be amended to provide a link to an HMCTS webpage that will set out how personal data will be processed and held by HMCTS. Examples of the forms that have been updated are set out in Practice note, GDPR: a guide for non-data protection lawyers (GDPR and DPA 2018) (UK): Dispute resolution. For more information generally on the UK GDPR, see Practice note, Brexit: implications for data protection: Applicable data protection laws in the UK following the expiry of the transition period.
Statements of truth: Under changes introduced by the 113th Practice Direction Update, from 6 April 2020, a statement of truth must include a warning that contempt proceedings may be brought for giving a statement of truth without an honest belief in its truth. For more information, see Practice note, Statements of truth: Wording of statement of truth: Statements of case and Witness statements.
(Note: The CPR provisions that relate to court forms are CPR 4 – Forms.)
