A tenant's notice under section 5 of the Agricultural Tenancies Act 1995 (ATA 1995) to terminate a fixed-term farm business tenancy (FBT), which was granted for a term of more than two years, on the last day of its contractual term. A section 5 notice is not appropriate where a fixed-term FBT of more than two years has continued after the term date as a statutory periodic tenancy from year to year. In these circumstances, either party must serve a notice to terminate the yearly periodic FBT in accordance with section 6 of the ATA 1995.
